A Brief Introduction to the Reform of Commercial System to Further Reduce the Burden of Enterprises

1.       Promoting the online processing of the whole business establishment

Fully promote the All-in-One network for Business establishment. Before the end of 2020, set up the All-in-One network platform for business registration in all provinces, autonomous regions, municipalities directly under the central government and Xinjiang production and Construction Corps, so as to realize the online processing of the whole enterprises registration , and further reduce the setup time of enterprises to 4 working days or even less. On this basis, explore and promote the standardized and normalized pilots for enterprises setup.

Continuously improve the service capability of enterprises setup. By relying on the All-in-One network platform, the online One form filling application for enterprise registration, official seal engraving, invoice and tax control equipment application, employee insurance registration and housing provident fund enterprise deposit registration is implemented. If the conditions are met, all the materials can be collected in One window off the line, or they can be handled without meeting each other through delivery, self-service printing, etc. Under the premise of strengthening supervision and ensuring safety, we should vigorously promote the application of electronic business license, electronic invoice, and electronic seal.

2.       Promoting the reform of registration system

Intensify the reform of the registration of residences and business places. Support Provincial People’s governments to carry out pilot projects of separation of residence and business premises. Market entities can register one residence and multiple business premises. The residence shall be registered as a correspondence address and the place where judicial documents (including administrative law enforcement documents) are served, and the system of self-declaration and commitment shall be implemented. For business places, all localities may formulate relevant management measures considering the actual situation. If a market entity carries out business activities outside its domicile and is under the jurisdiction of the same county registration authority, it is not necessary to set up a branch office. It is enough to apply for registration of additional business places, to facilitate enterprises to expand their business scale.

Improve the intelligent level of enterprise name self-declaration system. Standardize the management of enterprise name registration according to law, use big data, artificial intelligence and other technical means to strengthen the real-time maintenance of prohibited and restricted words, and improve the ability to analyse and identify inappropriate words. Promote the interconnection and sharing of trademark databases such as trademarks and enrich the contents of notification and prompt for enterprises. Explore Enterprise commitment and Supervision in and after the event to reduce the Approximate name manual intervention. Strengthen the protection of well-known enterprises?names and brands and establish a mechanism for handling name disputes.

3.       Simplifying the production and operation and approval conditions of related enterprises

Promote the reform of the production license system for industrial products. The examination and approval of 5 kinds of products, such as building steel bar, cement, radio and television transmission equipment, RMB identification instrument and prestressed concrete simply supported beam of railway bridge, shall be delegated to the provincial market supervision department. Improve strict quality and safety supervision measures, strengthen supervision and guidance, and keep the bottom line of quality and safety. Further expand the scope of implementation of notification commitment and promote the adjustment of chemical fertilizer products from the current post site review to notification commitment. Publicize and interpret the policies, standards and technical specifications related to the production license of industrial products, strengthen the guidance for enterprises to apply for licenses, and help enterprises to obtain evidence conveniently.

Improve the compulsory product certification system. Expand the scope of designated certification implementation agencies, improve the one-stop service capability of certification and testing institutions, and facilitate enterprises to apply for certification and testing. The cost of compulsory product certification for explosion-proof electrical appliances, gas appliances and large volume refrigerators shall be borne by the financial department. Simplify the certification procedures for export to domestic products. Supervise and guide the designated certification implementation agency of compulsory products, shorten the processing time of certification certificate, and reduce the certification cost by opening green channel, accepting the existing conformity assessment results and expanding online services. We should do a good job in certification services and technical support, provide policy and technical training for export to domestic sales enterprises, streamline and optimize the certification scheme, arrange special personnel to track the certification process, and reasonably reduce the compulsory product certification fees for export to domestic products.

Deepen the reform of qualification accreditation of inspection and testing institutions. In 2021, implement the notification and commitment system for qualification certification of inspection and testing institutions nationwide. The online examination and approval of qualification accreditation of inspection and testing institutions shall be comprehensively carried out, and the information query function of institutions shall be improved.

Speed up the cultivation of enterprise standard Leader. Optimize the system and mechanism of the Leader of enterprise standards, improve the evaluation scheme, promote the third-party evaluation institutions to publish a number of enterprise standards ranking lists, form a list of  Leader of enterprise standards in 2020, and guide more enterprises to declare and publicize higher quality standards.


4.       Strengthening supervision during and after the event

Strengthen enterprise information publicity. With the unified social credit code as the logo, a more perfect enterprise credit record will be integrated and publicized to the society in accordance with laws and regulations through the national enterprise credit information publicity system, Credit China website or China government website and relevant department portal websites.

A sound punishment mechanism for breach of faith. Implement the policy of integrating multiple reports into one in the annual report of enterprises, further optimize the working mechanism, vigorously implement the credit commitment system, and improve the systems and mechanisms of credit restoration and forced withdrawal. In accordance with the law and regulations, use credit management means such as the list of serious breach of credit in various fields, improve the level of collaborative supervision, and strengthen the punishment for dishonesty.

Promote the implementation of smart supervision. Improve the system of recall of defective products, urge enterprises to fulfill their legal obligations of defect recall and eliminate potential safety risks of products. Promote the combination of double random sampling and credit risk classification supervision, make full use of big data and other technologies, and take differentiated classification and supervision measures for the inspection objects of different risk grades and credit levels, and gradually realize accurate identification and prediction and early warning of the credit risk status and main risk points of the enterprise.

Regulate the economic supervision behaviour of the platform. Adhere to the principles of prudence and inclusiveness and encourage innovation, give full play to the role of self-discipline and enterprise autonomy in the platform economy, guide the orderly competition of platform economy, oppose unfair competition, and standardize the development of online economy. Investigate and deal with e-commerce violations in accordance with the law, maintain a fair and orderly market order, and create a good business environment for the development of platform economy.
